At the Sussex County Sheriff's Office, West Complex, 22215 DuPont Boulevard, Georgetown, Delaware, Georgetown Hundred, Sussex County, State of Delaware, the following described real estate to wit:

TRACT No. I:
All that certain lot, piece or parcel of land situated in Baltimore Hundred, Sussex County, and The State of Delaware, being all of Lot 17, as shown on a Plat of Bay View Estates, Section 5, recorded in the Office of the Recorder of Deeds, in and for Sussex County, at Georgetown; Delaware, in Plat Book 8, page 710; lying on the southwesterly side of Boatsun's Circle (at 50.00 feet wide), a short distance northeasterly of Bay View East (at 50.00 feet wide); and more particularly described, as follows, to wit:

BEGINNING at a re-bar found located in the southwesterly right-of-way of Boatsun's Circle, a corner for this lot and Lot 18; thence along the line of Lot 18 South 21 degrees 36 minutes West passing over a rebar found at 120.00 feet and continuing on for a total distance of 135.00 feet to a point in the Lagoon, a corner for this lot; thence turning and running along the said Lagoon North 68 degrees 30 minutes west 76.26 feet to a point, a corner for this lot and Lot 16; thence along the line of lot 16 North 21 degrees 30 minutes east passing over a re-bar found at 15.00 feet and continuing on for a total distance of 135.0' feet to a re-bar found in the southwesterly right of way of Boatsun's Circle, a corner for this lot and Lot 16; thence along the southwesterly right of way of Boatsun's Circle, South 68 degrees 30 minutes east 76.26 feet to the point and place of beginning, said to containing 10,295 square feet, more or less with tile improvements located thereon, as surveyed by Laud Tech, Inc., Elton M. Being the same lands and premises which William D. Cornell and Kathryn V. Cannel Cornell did grant and convey unto Joseph Kapinos by deed dated April 5, 2004 and recorded on April 16, 2004 in the Office of the Recorder of Deeds, in and for Sussex County, State of Delaware, in Deed Book 2966 Page 128.

Registration is required for all bidders prior to sale. A $4,000.00 deposit (Cash or Cashiers/certified check payable to Sheriff of Sussex County) and valid driver’s license or photo I.D. are required to register.

TERMS: 20 percent of the purchase money will be demanded on day of sale (The $4,000.00 Bidder Registration Fee will be credited to the 20% deposit). Cash, Certified Check or Cashier's Check, is required. The balance is to be paid on or before July 7, 2008. Sale subject to confirmation by the Superior Court on July 11, 2008 and also subject to a 1 1/2 percent Delaware Realty Transfer Tax; 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Also subject to 1 1/2 percent Sussex County Realty Tax, 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Any further Transfer Tax is the responsibility of the Purchaser.
